1. Agreement to Terms

By downloading, installing or using Temia ("the App"), you agree to these Terms of Service ("Terms") and to our Privacy Policy. If you do not agree, do not use the App. Apple's Licensed Application End User License Agreement also applies to your use of the App; where it conflicts with these Terms, these Terms apply to the extent Apple allows.

2. Definitions

  • "Service" means the Temia app and the services behind it.
  • "You" means the person using the App.
  • "Content" means photos, clips and text you upload or enter, and the results the App creates for you.
  • "Credits" means the in-app units you spend to create results.
  • "We", "us" and "our" means Mitat Enes Özdemir, the developer of the App.

3. Eligibility

You must be at least 13 years old to use Temia. If you are under 18 (or under the age of digital consent in your country), you need a parent's or guardian's permission.

4. The Service

Temia creates AI photos and videos from templates: you choose a template, add your photo (or photos), and the App makes a result you can keep, save and share. Templates, AI models and features change over time; we may add, change or remove them.

Videos you save or share from the App may end with a short "Made with Temia" card.

5. Your Account

  • Temia creates an anonymous account on your device; no sign-up is needed.
  • Your account is tied to your device. Keep your device secure; if you lose access to it, we may not be able to recover the account. Purchases can be restored with "Restore Purchases" under the same Apple ID.
  • Tell us at once if you believe someone has misused your account.

6. Your Content

6.1 Ownership

You keep your rights to the photos and clips you upload and, as between you and us, to the results created from them. We claim no ownership of your Content.

6.2 Permission you give us

You give us a limited, worldwide, non-exclusive licence to host, process and transmit your Content (including through our service providers, such as the AI provider fal.ai) only as needed to provide the Service to you: to make your results, store them in your account and show them to you. We do not use your Content to train AI models or in advertising without your separate permission. This licence ends when you delete the Content or your account.

6.3 Rules for Content

You must have the right to use every photo you upload, including the permission of anyone shown in it. Do not upload or try to create content that:

  • shows or sexualises minors in any way, or is sexual, nude or intimate;
  • is violent, hateful, harassing, or promotes self-harm or illegal activity;
  • impersonates someone, or shows a real person in a way that could mislead, defame or embarrass them, without their consent;
  • infringes someone else's intellectual property, privacy or publicity rights;
  • is intended to deceive (for example fake documents or fake evidence).

Requests are checked automatically and may be refused. You can report a result in the App. We may remove Content and suspend or close accounts that break these rules.

6.4 Your responsibility

You are responsible for the Content you upload and for how you use and share results. AI results are generated automatically and can be inaccurate or unexpected; do not present them as real footage of real events.

7. Subscriptions, Credits and Payments

7.1 Plans and credits

Creating a result costs credits; each template shows its cost before you create. You get credits with a subscription or by buying a credit pack:

  • Weekly plan: 500 credits each week.
  • Monthly plan: 1,500 credits every 30 days.
  • Annual plan: 800 credits every 30 days.
  • Credit packs: a one-time amount of credits shown at purchase.

Plans and prices offered in the App may change and may differ by country; the price you pay is shown by Apple before you buy.

7.2 How credits work

  • Subscription credits are valid for the credit period they come with (7 days for weekly, 30 days for monthly and annual) and do not roll over.
  • Pack credits do not expire while your account exists.
  • Subscription credits are used first, then pack credits.
  • If a creation fails, its credits are returned automatically.
  • We may grant bonus credits (for example with a renewal), and we may change credit costs and bonuses; changes do not affect credits you already hold.
  • Credits have no cash value and cannot be transferred, exchanged or refunded, except where the law requires. They end when your account is deleted.

7.3 Billing, renewal and cancellation

  • Payments are processed by Apple and charged to your Apple ID. We never receive your payment details.
  • Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends; your Apple ID is charged within 24 hours before renewal.
  • Cancel any time in your iPhone's Settings → Apple ID → Subscriptions. You keep access until the end of the period you paid for. Deleting the App or your account does not cancel a subscription.
  • Introductory offers (for example a discounted first week) and promotional offers are available only to eligible accounts under Apple's rules. After an offer period, the plan renews at its regular price unless you cancel.
  • We may change subscription prices; Apple will inform you as its rules require before a higher price applies to your subscription.

7.4 Refunds

Refunds are handled by Apple under Apple's policies; request one at reportaproblem.apple.com. We cannot issue refunds for App Store purchases ourselves.

8. Licence and Acceptable Use

We give you a personal, non-exclusive, non-transferable, revocable licence to use the App. You may use your results for personal and commercial purposes in line with section 6, but you may not:

  • copy, modify, reverse engineer or resell the App or access to its features;
  • use bots, scripts or other automated means to access the Service, or try to get around credits, limits or safety checks;
  • interfere with the Service or try to access other users' data;
  • use the Service to break the law or anyone's rights.

9. Intellectual Property

The App, the Temia name and logo, its design, templates, prompts and other materials belong to us or our licensors. The AI models are provided by third parties under their own terms. You may not use the Temia name or logo without our written permission.

10. Changes and Availability

We update the App and the Service from time to time, and we may change, suspend or end features. We do not promise that the Service will always be available or error-free. We may update these Terms; the date above shows the latest version, material changes will be announced in the App, and continuing to use the App after a change means you accept it.

11. Termination

You can stop using the App and delete your account at any time (Settings → Delete Account). We may suspend or close your account if you break these Terms, misuse the Service, or if the law requires it. When an account is closed, its Content and credits are deleted; subscriptions continue to be billed by Apple until you cancel them there. Sections 6.4, 9, 12, 13, 14 and 15 survive termination.

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. AI results vary and may not match your expectations; we do not guarantee any particular result.

13. Limitation of Liability

TO THE EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR USD 100, WHICHEVER IS LESS. Some jurisdictions do not allow these limits; there, they apply only as far as the law permits. Nothing in these Terms limits liability that cannot be limited by law.

14. Indemnity

To the extent the law allows, you agree to cover our reasonable losses and costs arising from your Content or your breach of these Terms or of someone else's rights.

15. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Türkiye, and the courts of İstanbul have jurisdiction, without depriving you of the protection of mandatory consumer laws of the country where you live, or of your right to bring a claim there. Before bringing a claim, please contact us so we can try to resolve it informally.

16. General

If any part of these Terms is found unenforceable, the rest stays in effect. Not enforcing a right is not a waiver of it. You may not transfer these Terms; we may transfer them to a successor of the App. These Terms and the Privacy Policy are the entire agreement between you and us about the App.
